The death of former Tata Sons chairman Cyrus Mistry in a road accident has raised several questions regarding insurance policy claims in accident cases. However, insurance companies say that people buy insurance to hedge against risk. Therefore, in case of accidental death due to human error or any other reason, the policyholder will definitely get the benefit of insurance.

The industry says that even in case of human error or violation of rules, full benefits of the insurance policy will continue and claims for accidental death will continue to be accepted. However, the amount of compensation can be reduced in exceptional cases.

Payment will have to be made as per the policy conditions
Tapan Singhla, Managing Director, Bajaj Allianz General Insurance said, If the policyholder has a comprehensive motor insurance policy, then according to its terms, the policyholder will be paid if the vehicle is damaged in a road accident. Apart from this, if the people traveling in that vehicle are also victims of the risk, then it also comes under the purview of the policy. Sanjay Dutta, Head (Risk Assessment & Claims) at ICICI Lombard General Insurance Company said that most of the accidents happen

due to human negligence .

Claim cannot be rejected on the basis of seat belt
Another insurance company official said, the insurance company is legally bound to honor the claim of damage to the vehicle if the unfortunate incident happens due to negligence. The policy claim cannot be rejected on the basis of whether the rear seat passengers were wearing seat belts or not.
Pawanjit Singh Dhingra, Joint MD, Prudent Insurance Brokers said, “Seat belt is not the subject matter of the insurance contract. Therefore, the passenger injured or killed in the accident has the right to get a third party claim.
