The Himachal Pradesh State Consumer Disputes Redressal Commission has ordered ICICI Lombard Insurance Company to pay Rs 4.65 lakh. A bench of the commission’s chairman, retired judge Inder Singh Mehta, members Sunita Sharma and RK Verma modified the decision of the forum. The commission has also ordered to pay nine percent interest on this amount.
The vehicle of the complainant had suffered substantial damage due to the accident that occurred during the period of insurance. The insurance company had estimated the loss of the vehicle at Rs 5,65,345. The company had refused to pay damages saying the driver did not have a valid licence. The forum had accepted the complaint of Bir Singh, a resident of Shimla. The forum had ordered the insurance company to pay full claim for the loss of the vehicle.
Subsequently, the insurance company challenged the decision of the Consumer Disputes Redressal Forum. It was argued on behalf of the insurance company that the complainant has sold the accidental vehicle in junk for one lakh rupees. The company is not bound to compensate the entire loss of the vehicle. Modifying the decision of the forum, the commission has ordered the insurance company to pay Rs 4.65 lakh.
